Samantha & Lindsay - Girls, Drop the Lawsuit
Unless Samantha Ronson can prove that her attorney, Martin Garbus, told her that she had an open and shut case against Perez Hilton AND can prove that he knew all of the facts at the time he gave her the advice to sue Perez Hilton - - - Samantha does not have a snowball’s chance in hell of winning a malpractice case against the legal weasel.
Wonder who’s representing her now and willing to file such a crazy lawsuit? Sam - you need to get some new attorneys.
So girls —- really — drop the lawsuit. Of course, we would have told you that the first time. You’re public figures - at least limited public figures — for purposes of defamation suits. These cases are nearly impossible to prove and almost always get dismissed on the pleadings or summary judgment. Garbus should have told you that but he’ll claim that he did and that you left out important facts - no doubt facts that will look bad for you two. Here is a little tip - attorneys aren’t always truthful.
Let’s back up and see if we can get this right. Samantha Ronson sued online gossip mangina queen Perez Hilton for defamation. The claimed defamation? Perez repeated a report that first appeared on the Web site www.CelebrityBabylon.com that Samantha Ronson had planted illegal drugs (cocaine) in the car of Lindsay Lohan.
According to the lawsuit, both postings defamed Ronson by stating she planted drugs that were found in Lohan’s car after it crashed into a tree in Beverly Hills on May 26, 2007, and that Ronson set up Lindsay to be photographed while under the influence of alcohol.
Samantha apparently settled a similar suit against Jill Ishkanian, whose Sunset Photo and News Agency operates www.CelebrityBabylon.com.
Since Ronson is probably at least a limited public figure for purposes of a defamation suit (lawyer talk here) Ronson could win only if she could show “malice.” Of course, Perez Hilton doesn’t have enough brains to have malice. He just wants attention.
So the lawsuit by Ronson against Perez was thrown out and . . . was found to be frivolous, entitling Perez to costs and attorneys fees. When Ronson didn’t pay up Perez asked for a debtor’s exam (don’t worry no body cavity searches), and within the last couple of weeks Perez got nearly $87,000 from Sam and/or Lindsay.
Well, Samantha is now suing her attorney, Martin Garbus, claiming professional malpractice on his part. And, now, our favorite lesbian hero has been noticed for a video deposition by Ronson’s former attorney. Apparently Garbus wants to question her “about the details of the drugs allegedly found in the car and of her alleged romantic relationship with Ronson.”
Lindsay doesn’t want the video to hit the Internet. Gee - would it really? Can’t imagine that. Do you think we’d do such a thing? I’m sure that Perez wouldn’t do such a thing. In fact, she’s so worried about her testimony that Lindsay’s also requesting that the deposition (sworn testimony out of court) be held at a private location, with minimal witnesses, no video, and a sealed transcript.
Instead of going through all of these motions - DROP THE LAWSUIT!!! No one gives a crap about what happened in the past and you’re out the money. Now go try to stir up some good work and chalk it up to lessons learned.
Attorney Garbus has represented clients as diverse as Don Imus, the comic Lenny Bruce, New York City Mayor Michael Bloomberg, Nancy Reagan, and pioneering rap group Public Enemy.
